Prepared by specialist landlord and tenant lawyer Tessa Shepperson (creator of the Lodger Landlord and Landlord Law websites), this form amends the tenancy agreement incorporating new clauses to protect the landlord's permission.

The protective clauses in the form include:

  • A requirement that your tenant to carry out referencing and credit checks and
  • Do the 'right to rent check', and
  • Provide copies of these to you on request
  • It requires them to notify you before accepting a lodger and allows you a veto if you are unhappy about the person chosen
  • Your tenant is required to sign a lodger agreement form with the lodger (included with this pack) and provide you with a copy
  • Your tenant is required to ensure that the lodger vacates before the tenancy ends or be responsible to you for the costs of evicting the lodger
  • Your tenant will be held liable for any damage done by the lodger to the property, and
  • Is obliged to terminate the lodger agreement on request from you provided this request is reasonable

Other clauses require the tenant to comply with the legislation which allows lodger landlords to evict lodgers easily, deal with Council tax requirements plus there is a space for you to add any extra clauses you wish to include.

Most tenants will be only to willing to ensure that the lodger chosen is a responsible person who they can  trust.  After all the lodger will be living in their home!

What happens next?
